Strauss-Kahn asks NY court to dismiss maid's suit (AP)
NEW YORK ? Dominique Strauss-Kahn claimed Monday he has diplomatic immunity and asked a New York court to dismiss a lawsuit filed by the hotel maid who says he sexually assaulted her.
Attorneys for the former International Monetary Fund leader filed the motion in a Bronx court, arguing judges there do not have the ability to try the case, because Strauss-Kahn's time as head of the fund gives him immunity from the litigation.
The 62-year-old Strauss-Kahn was initially charged with attempted rape and held under pricey house arrest after the maid, Nafissatou Diallo, said he attacked her in his hotel suite May 14 and forced her to perform oral sex. The case was eventually dismissed when prosecutors said they had lost faith in Diallo's credibility after a series of lies she told them unrelated to the assault allegations.
Attorneys for Diallo, who came forward publicly in a series of interviews, filed the lawsuit against Strauss-Kahn in the Bronx Aug. 8 as the criminal case was still active. It recounted in graphic detail the woman's version of the encounter but did not ask for specific damages.
There is a lower burden of proof in civil cases, and it is possible that Strauss-Kahn would have to testify if it went to trial. He recently spoke about the incident at the Sofitel Hotel in an interview broadcast on French television, calling the encounter a "moral failing," but he said it "did not involve violence, constraint or aggression."
The 32-year-old Guinean immigrant maintains Strauss-Kahn attacked her. Her attorney, Kenneth Thompson, said Monday the diplomatic immunity claim would fail because he is not an official diplomat and was on "personal" business when the incident occurred.
"This baseless motion is another desperate attempt to avoid having to answer for the deplorable acts he committed against Ms. Diallo," Thompson said.
The documents filed Wednesday argue that Strauss-Kahn should be immune under international law even though he had already resigned his post as head of the IMF when the lawsuit was filed. His immunity stood until he left the country, shortly after his case was dismissed, his lawyers argued.
Strauss-Kahn's travel documents are stamped "DIPLOMATIC" in bright red lettering, and signed by the Secretary-General of the United Nations. The documents recite in six languages that the bearer is entitled to international immunities, according to the court documents.
His attorneys, William Taylor and Benjamin Brafman, also filed a motion to delete paragraphs in Diallo's lawsuit that detail the encounter as fact from her perspective.
The Associated Press does not generally name accusers in sexual assault cases unless they agree to be named or identify themselves publicly, as Diallo has done.
A French writer has accused Strauss-Kahn of trying to rape her in 2003. The two have been ordered to appear before a judge in Paris to tell their stories as part of an investigation into the case. No date for the so-called face-off has been set.

SEATTLE (AP) ? Homes across north Seattle were rattled by an explosion Monday morning that destroyed a house and sent two residents to a hospital.
Two hours later, firefighters were still putting out hot spots and two dozen homes were evacuated while Puget Sound Energy crews worked to stop a natural gas leak, Fire Department spokesman Kyle Moore said.
Metro buses were brought in to shelter residents from the rain.
The explosion around 6 a.m. broke windows in the neighborhood where debris rained down.
Arriving firefighters found the house in flames and a man and woman in their 50s with burns, Moore said. They were taken to Harborview Medical Center. The woman has life threatening injuries; the man is in serious condition.
The flames were visible from Interstate 5.
Puget Sound Energy crews responded, spokeswoman Allison Stanford confirmed.
There had been a natural gas leak Sunday about five blocks away, Moore said. However, it remained for investigators to determine whether a natural gas leaked caused the blast, he said.
"It's easy to speculate it's related," Moore said. "We're saying we want to let investigators have time inside the structure to determine what the cause was."
Jordan Entler, who lives on the third floor of a building across the street, said the explosion knocked pictures off his wall.
"I thought it was an earthquake, or something that had landed on my roof," he said. "Then I went outside and saw this big ball of flame."
He went to the neighbors' home across the street and made sure they were able to get outside. All of the windows on the back side of their house were blown out, Entler said.

NASA: 6-ton satellite hits Earth; location unknown (AP)
WASHINGTON ? NASA's dead 6-ton satellite plunged to Earth early Saturday, but more than eight hours later, U.S. space officials didn't know just where it hit. They thought the fiery fall was largely over water and the debris probably hurt no one.
The agency did not give a more specific location in a midday update on its website, which also said officials were not aware of any reports of injuries or property damage. Most of the spacecraft was believed to have burned up.
The bus-sized satellite first penetrated Earth's atmosphere somewhere over the Pacific Ocean, according to NASA and the U.S. Air Force's Joint Space Operations Center. But that doesn't necessarily mean it all fell into the sea.
NASA's earlier calculations had predicted that the 20-year-old former climate research satellite would fall over a 500-mile swath and could include land.
Because the plummet began over the ocean and given the lack of any reports of people being hit, that "gives us a good feeling that no one was hurt," but officials didn't know for certain, NASA spokesman Steve Cole told The Associated Press.
The two government agencies said the 35-foot satellite fell sometime between 11:23 p.m. EDT Friday and 1:09 a.m. EDT Saturday, but with no precise time or location.
There was rampant speculation on the Internet and Twitter, much of it focusing on unconfirmed reports and even video of debris from the Upper Atmosphere Research Satellite over Alberta, Canada.
Jonathan McDowell of the Harvard-Smithsonian Center for Astrophysics said the spacecraft entered the atmosphere around 12:15 a.m. EDT over the coast of Washington. He said much of the debris likely fell over the Pacific Ocean, though its trajectory suggests some of it could have fallen over more heavily populated areas in the U.S. and Canada, including Portland, Ore.; Seattle; Calgary, Alberta; and Saskatoon, Saskatchewan.
"Pieces are falling off of this flaming fire ball, and some of it has enough momentum to go hundreds of miles," he said.
Cole said that was possible because the last track for the satellite included Canada, starting north of Seattle and then in a large arc north then south. From there, the track continued through the Atlantic south toward Africa, but it was unlikely the satellite got that far if it started falling over the Pacific.
Cole said NASA was hoping for more details from the Air Force, which was responsible for tracking debris.
But given where the satellite may have fallen, officials may never quite know precisely.
"Most space debris is in the ocean. It'll be hard to confirm," Cole said.
Some 26 pieces of the satellite representing 1,200 pounds of heavy metal had been expected to rain down somewhere. The biggest surviving chunk should be no more than 300 pounds.
UARS is the biggest NASA spacecraft to crash back to Earth, uncontrolled, since the post-Apollo 75-ton Skylab space station and the more than 10-ton Pegasus 2 satellite, both in 1979.
Russia's 135-ton Mir space station slammed through the atmosphere in 2001, but it was a controlled dive into the Pacific.
Before UARS fell, no one had ever been hit by falling space junk and NASA expected that not to change.
NASA put the chances that somebody somewhere on Earth would get hurt at 1-in-3,200. But any one person's odds of being struck were estimated at 1-in-22 trillion, given there are 7 billion people on the planet.
The satellite ran out of fuel and died in 2005. UARS was built and launched before NASA and other nations started new programs that prevent this type of uncontrolled crashes of satellite.

Palestinian crisis looms over U.N. meeting (Reuters)
UNITED NATIONS (Reuters) ? Diplomats scrambled on Thursday to head off a clash over Palestinian plans to seek full U.N. recognition with little visible sign of progress and a deadline less than 24 hours away.
Iranian President Mahmoud Ahmadinejad briefly seized the spotlight at the United Nations General Assembly, accusing the United States of using the September 11, 2001, attacks as a pretext for attacks on Iraq and Afghanistan and condemning western support for Zionism.
But attention focused on the crisis transfixing this year's U.N. meeting. Palestinian President Mahmoud Abbas is ready to submit his application to the U.N. Security Council on Friday despite pressure from U.S. President Barack Obama to forgo the U.N. option and resume direct talks with Israel.
Obama's meetings with Abbas and Israeli Prime Minister Benjamin Netanyahu on Wednesday ended with no breakthrough, illustrating stark new limits of U.S. influence over a process spinning in unpredictable directions.
Obama, whose personal efforts to restart the Middle East peace process have proved fruitless, on Wednesday declared that direct talks were the only path to Palestinian statehood, underscoring unbending U.S. opposition to the U.N. plan.
Obama said the United States will veto any Palestinian move in the Security Council -- a step that would isolate Washington with its ally Israel at a moment of unprecedented political turmoil across the region.
"We understand that the Palestinian people feel like they have waited very long, and far too long, to have their own state. We want to help them achieve that state as quickly as possible," U.S. Ambassador to the United Nations Susan Rice told U.S. NPR radio.
"But the bottom line is there's no way to accomplish that short of the two sides coming back to the negotiating table," Rice said, calling the Palestinian U.N. bid "unwise and counterproductive."
U.S. Secretary of State Hillary Clinton, who had her own meetings with Abbas and Netanyahu, said the United States would continue to push for a durable, negotiated peace.
"Regardless of what happens tomorrow in the United Nations, we remain focused on the day after," Clinton told reporters.
ON THE GROUND REALITIES
Whatever happens at the United Nations, Palestinians will remain under Israeli occupation and any nominal state would lack recognized borders or real independence and sovereignty.
The cash-strapped Palestinians face their own political divisions, and may also incur financial retribution from Israel and the United States that could hobble their efforts to build the framework of government for their homeland.
But in the West Bank, Palestinians have rallied this week to support the U.N. plan, with many expressing anger and disappointment over two decades of failed U.S. policy peace policy.
At the United Nations, diplomats are focused on several scenarios which they hope may contain the damage once Abbas makes his application, as most expect he will.
The Security Council could delay action on Abbas' request, giving the mediating "Quartet" -- the United States, Russia, the European Union and the United Nations -- more time to craft a declaration that could coax the two sides back to the table.
But the Quartet may be unable to agree on a statement that could satisfy both Israel and the Palestinians, which remain divided on core issues including borders, the status of Jerusalem, the fate of Palestinian refugees and the future of Jewish settlements.
A senior U.S. official said Quartet envoys met for several hours on Thursday.
Another option, advanced by French President Nicolas Sarkozy, would see the Palestinians go to the General Assembly, which could vote to upgrade the Palestinians from an "entity" to a "non-member state" while reviving direct peace talks.
Sarkozy's plan calls for talks to begin within one month, an agreement on borders and security within six months and a final peace agreement within a year.
The General Assembly route would require only a simple majority of the 193-nation body, not a two-thirds majority necessary for full statehood.
What remains unclear, however, is whether the Palestinians will insist on the right to haul the Israeli government or its officials before war-crimes tribunals or sue them in other global venues -- something Israel opposes.
The Palestinians have pledged to press the Security Council bid while keeping the General Assembly option open.

Iran's Ahmadinejad -- who arrived in New York this year weakened by factional infighting at home -- accused Western powers of a variety of misdeeds and again questioned the September 11, 2001, attacks as "mysterious."
In what has become a regular piece of political theater, U.S. and other Western delegations walked out of the General Assembly hall during his speech.
Although he did not mention Tehran's disputed nuclear program in his U.N. speech, Ahmadinejad said later that Iran would stop producing 20 percent enriched uranium if it is guaranteed fuel for a medical research reactor, seeking to revive a fuel swap deal that fell apart in 2009.
"Any time they can guarantee us this sale ... we will stop 20 percent enrichment," he told reporters, although deep Western skepticism over Iran's nuclear intentions would likely slow any possible resumption of talks.
The Iranian leader, who in the past has called Israel a "tumor" that must be wiped from the map, made only a passing reference to the Palestinian issue in his U.N. speech and had no comment on the Palestinians' bid for U.N. recognition.

Going back ten years ago this was not so much of a problem as Real Estate markets around the country were booming and a home was an investment windfall.? Every few months the value of homes would continue to rise and did so for over a decade. Of course all good things must come to an end eventually and now we are left with property values decreasing in most areas.
When the economy and Real Estate values are soaring it is hard not to look at a home as a giant piggy bank from which you can tap at a moments notice. When times are tough however, you may regret taking your equity for granted by pulling it out of the home.
Below is a guide to help you determine whether borrowing against the equity in your home via a home equity line of credit (HELOC), home equity loan or a cash out refinance makes the most sense.
Home Equity Line of Credit (HELOC)
Home equity lines of credit work much like credit cards do. As a borrower you are given a credit limit up to which you are allowed borrow. Also similar to credit cards is the fact that the loan is open ended and carries an adjustable interest rate. Home equity lines of credit are tied to the prime rate as a basis to lend money.
Typically borrows can expect to pay the prime rate plus 2% as an example. Like credit cards HELOC?S can be closed by lenders at any point in time. Like any other loan it is prudent to shop around for the best rate and terms. Make sure you only borrow what you can afford as this loan is directly tied to your home and if you can not afford to make payments you could potentially lose your home to foreclosure.
The biggest advantage to a home equity line of credit is you can borrower whatever you need, up to whatever amount the lender has set, whenever you need it. The big draw back however is the lender can shut off the line of credit if the value of your home falls, your credit takes a hit or if the lender just decides they don?t want to offer you credit anymore.
Home Equity Loan
Often times a home equity loan has a fixed interest rate but also could be variable as well. Like either of the other financing options if you don?t pay it back the lender would have the option to foreclose!
Most of the time a home equity loan option is used for a specific purpose where the cost is known ahead of time. For example paying for the kids college education or buying a new car. What you need to decide is whether you would get more favorable loan terms by going this route or by getting an unsecured loan somewhere else such as at credit union or local lender. Sometimes this decision boils down to how conservative you want to be. You may get a better interest rate by getting a home equity loan but is it worth the risk of having it secured against your home?
Some borrowers would say no. If you happen to lose your job and have an equity loan against the family home for $150,000 this may not put you in a comfortable position. You should also check to see if there are any penalties for paying off the loan balance early. A number of lenders will charge a pre-payment penalty fee if you sell the home.
Cash Out Re-finance
A cash out re-finance is when you pay off your existing loan and get a new loan for the old mortgage balance plus whatever additional amount you need to borrow plus any closing costs. If the cash out refinance interest rate is lower than the existing mortgage rate, this option is probably going to be the best route to take. Most of the time you are going to be able to get a better interest rate with a 1st mortgage than going to the 2nd mortgage option. It is likely cheaper to borrow this way than having the combination of two mortgages. This is especially true when fixed rate mortgages are very low.
Nowadays when getting any type of mortgage it really makes sense to look over your ability to pay it back. The last thing you want to do is find yourself in an uncomfortable financial situation. Padres pitching having a say in NL West race (AP)
SAN DIEGO ? Although it won't pitch beyond September, the San Diego Padres' staff is having a say in the NL West race.
The last-place Padres surprised NL West-leading Arizona for the second straight night, winning 3-1 on Saturday as Wade LeBlanc and three relievers combined on a five-hitter and Orlando Hudson and Jeremy Hermida hit solo homers.
It was the second straight night the Padres held the Diamondbacks to five hits, also doing so in Friday night's 2-0 win.
"We won two ballgames in a row. We're going to come out tomorrow and try to keep it rolling," LeBlanc said. "We've got some momentum, we've got some good pitching going. We got some timely hits that we need. We're going to try to finish out the season strong."
LeBlanc (4-5) allowed four hits, struck out four and walked three. Relievers Luke Gregerson and Chad Qualls each threw a scoreless inning before All-Star Heath Bell pitched the ninth for his 39th save in 44 chances. Bell struck out Justin Upton looking and got Miguel Montero to fly out to left before allowing a single to Paul Goldschmidt and walking Chris Young on four pitches. Bell ended it by throwing a called third strike past pinch-hitter Lyle Overbay on a full-count pitch.
A week earlier, Bell blew a save at Arizona by allowing consecutive ninth-inning homers to Young and Overbay, then Joe Thatcher walked in the winning run in the 10th inning.
"C.Y. and Overbay got me in Arizona so I wasn't going to give in. I fell behind and made some good pitches off Lyle, right on the corner. C.Y., I didn't make that good pitch, but then again I didn't want him to shoot the ball into right. I wasn't going to give in to those guys. I got Lyle instead of C.Y. I had a base.
"That's kind of our motto, defense and pitching," Bell added. "Good fundamental baseball and good pitching. We're starting to get some good pitching from our starters, and our bullpen's doing what it's supposed to be doing."
Manager Bud Black agreed.
"Our guys, from Wade on down, made pitches when they had to," Bud Black said. "They were stressed a couple times, each guy with the exception of Chad, who had a 1-2-3. Wade's ball-strike ratio wasn't great, but through the game he made pitches when he had to. Came back from deep counts and got outs."
The Diamondbacks came into the game with a magic number of six for clinching the division title. Any combination of Diamondbacks wins and San Francisco Giants losses totaling six will give Arizona the title. The defending World Series champion Giants were playing at Colorado on Saturday night.
Arizona lost its third straight game, its longest losing streak since dropping six from Aug. 17-22. The Diamondbacks also had only five hits in Friday night's 2-0 loss at San Diego.
With the score tied at 1, Hudson homered onto the top of the out-of-town scoreboard on the right-field wall with two outs in the fourth, his seventh. It came on a full-count pitch from Josh Collmenter (9-10).
Hermida led off the seventh with a homer into the seats in right-center, one of the deepest parts of Petco Park. It was his second.
LeBlanc's only mistake was allowing Aaron Hill's solo shot to left-center on a full-count pitch with one out in the first, his second.
San Diego tied it in the second when Hudson hit a two-out single to right, advanced when Hermida was hit by a pitch and scored on Andy Parrino's single.
Collmenter allowed three runs and eight hits in seven innings, struck out two and walked none.
NOTES: The Padres will wait a few days to determine whether RHP Tim Stauffer makes his next start. He left Friday night's win with tightness in his right arm. ... The series concludes Sunday with Arizona LHP Joe Saunders (11-12, 3.83) facing San Diego RHP Aaron Harang (13-6, 3.85). Harang has gone 4-2 with a 2.62 ERA in his last 10 home starts since May 19. ... The modern office environment has changed dramatically in recent years as a result of new office technologies and an increased reliance on electrical equipment. Improper use of this workplace equipment can cause serious electrical shock and burn injuries.
?Electrical accidents that occur in an office environment are usually a result of faulty or defective equipment, unsafe installation, or misuse of equipment ? specifically, extension cords, power strips, and surge protectors,? says Brett Brenner, president of the Electrical Safety Foundation International.
National Electrical Safety Month is a great time to review workplace electrical safety practices. Effective electrical safety programs increase safety awareness, provide established safety guidelines, and ensure the proper tools and technology are used to mitigate the risks associated with electrical safety hazards.
Awareness of electrical hazards is critical to preventing accidents and creating a safer work environment. Following basic safety principles can help to ensure your safety and the safety of those around you:
Surge protectors protect equipment, but they do not provide protection from the potential hazards of an overloaded circuit. Make sure the electrical load is not too great for the circuit.
Avoid overloading outlets with too many appliances. Never plug in more than one high-wattage appliance at a time.
Unplug appliances when not in use to conserve energy, but also to minimize the opportunities for electric shock or fire.
Inspect electrical cords once a month to ensure that they are not frayed, cracked, or damaged.
Do not place electrical cords in high traffic areas, under carpets or across doorways where they pose a potential tripping hazard.
Instead of relying on extension cords and power strips, consider having a licensed electrician install additional outlets where you need them.
Ensure that all electrical products and equipment are certified by a nationally recognized testing laboratory such as UL, CSA, or ETL, and read the manufacturer?s instructions carefully.

HUNTSVILLE, Texas (AP) ? A black man convicted of a double murder in Texas 16 years ago was at least temporarily spared from lethal injection when the U.S. Supreme Court agreed to review his lawyers' claims that race played an improper role in his sentencing.
The court on Thursday halted the execution for Duane Buck, 48, two hours into a six-hour window when he could have been taken to the death chamber. Texas officials, however, did not move forward with the punishment while legal issues were pending.
Buck was sentenced to death for the fatal shootings of his ex-girlfriend and a man in her apartment in July 1995. His attorneys had asked both the Supreme Court and Texas Gov. Rick Perry to halt the execution because of a psychologist's testimony that black people were more likely to commit violence. Buck's guilt is not being questioned, but his lawyers contend the testimony unfairly influenced the jury and Buck should receive a new sentencing hearing.
The nation's highest court, without extensive comment, said it would review an appeal related to that testimony. The decision meant Perry did not have to act on a request from Buck's lawyers that the governor use his authority to issue a one-time 30-day reprieve.
Buck's case is one of six that then-Texas Attorney General John Cornyn ? a political ally of Perry who is now a Republican U.S. senator ? reviewed in 2000 and said needed to be reopened because of racially charged statements made during the sentencing phase. In the other five cases, new punishment hearings were held and each convict again was sentenced to die.
State attorneys contend Buck's case was different from the others and that the racial reference was a small part of larger testimony about prison populations. Jurors in Texas must decide on the future danger of an offender when they are considering a death sentence.
Perry is a capital punishment supporter and as frontrunner for the Republican presidential nomination his actions now are coming under closer scrutiny. During his 11 years in office, 235 convicted killers in Texas have been put to death. His office said he has chosen to halt just four executions, including one for a woman who later was executed.
Buck's lawyers called to tell Buck of the reprieve and the inmate was praying in his cell when Texas Department of Criminal Justice spokesman Jason Clark approached.
"Praise the Lord!" Buck told Clark. "God is worthy to be praised. God's mercy triumphs over judgment.
"I feel good."
In its one-paragraph decision, the court said it stopped the punishment so it could further look at Buck's request, known as a writ of certiori. If the court decided against the writ, the justices said the reprieve would be lifted, meaning Buck could receive a new execution date.
"No one should be put to death based on the color of his or her skin. We are confident that the court will agree that our client is entitled to a fair sentencing hearing that is untainted by considerations of his race," Kate Black, one of Buck's attorneys, said.
Buck was convicted of gunning down ex-girlfriend Debra Gardner, 32, and Kenneth Butler, 33, outside Houston on July, 30, 1995, a week after Buck and Gardner broke up. A third person, Buck's stepsister, Phyllis Taylor, also was wounded, though she has since forgiven Buck and sought for his death sentence to be commuted to life in prison.
Buck's attorneys went to the Supreme Court after losing appeals in lower courts. A clemency request to the Texas Board of Pardons and Paroles, all of whom are Perry appointees, also failed.
Assistant Attorney General Edward Marshall had told the high court that Buck's appeals were attempts to relitigate claims that every court, including the Supreme Court, already rejected.
Perry was not in the state Thursday, meaning any final order to delay would have come from Lt. Gov. David Dewhurst. However, Perry's office frequently points out that he remains the governor and in contact with Austin while traveling.
Two more Texas prisoners are set to die next week.

UPS expects record profit, "slow-growth economy" (Reuters)
LOUISVILLE, Kentucky (Reuters) ? United Parcel Service Inc (UPS.N) Chief Executive Scott Davis said the world's largest package delivery company is on track for record results this year in the face of the economy's "bumpy ride" and expectations for sluggish economic growth.
Analysts were concerned that package delivery companies such as UPS and rival FedEx Corp (FDX.N) would fall short because of the economy and plummeting consumer sentiment. Even as the company repeated its expectations, concerns about near-term economic growth appear to be clouding the reaction of investors.
UPS shares closed at $66.18, essentially flat compared with the prior session. The Dow Jones Industrial Average was up about 1.6 percent, while FedEx was about 1.4 percent higher at $77.08
Since peaking in February, UPS shares have fallen 14 percent. FedEx shares have fallen 22 percent in that same time period.
"The last few months, we've seen a bumpy ride that may likely continue," Davis said. "Despite this great uncertainty UPS still expects to set a new high for EPS this year."
UPS repeated its forecast in July for record earnings per share of between $4.15 and $4.40, citing cost cuts and higher rates.
"The odds are higher than six to nine months ago, but I don't expect a double-dip," Davis told reporters at the close of the investor meeting. "I expect a slow-growth economy."
Davis and other UPS executives spoke at the Atlanta-based company's first investor meeting in more than three years.
The company's outlook, in spite of an unsettled global economy, follows similarly bullish comments by diesel engine maker Cummins Inc (CMI.N) on Tuesday.
General Electric Co (GE.N) Chief Executive Jeff Immelt said earlier on Thursday he sees "good, decent economic growth everywhere," including in the United States, and is not worried about the economy slipping back into recession.
Chief Financial Officer Kurt Kuehn said UPS remains cautious.
"We do remain cautious on the U.S. economy, but our expectation is that we have another year, year and a half, of sub-par growth and then we'll return" to pre-recession trend growth levels of 2.5 percent to 3 percent, Kuehn said.
Two expected UPS growth drivers are global trade that creates jobs and healthcare logistics, which the company is investing in heavily and which Davis said is in the "early innings of outsourcing."
"America is fed up and I am hopeful, maybe naively, that we will start seeing some policy decisions" shortly, particularly on global trade policies, Davis said, adding that one UPS job is created for every 22 packages that cross international borders.
"Consumer confidence, consumer trust in Washington, can't get much lower than it is right now," Davis said.
UPS's small-business customers will start hiring once there is some clarity, he added.
U.S. postal service downsizing and U.S. defense spending constraints that lead to greater outsourcing by the U.S.P.S. and the military are also growth opportunities, Davis said.
Kuehn said shippers continue to keep inventory light, suspicious of consumer demand heading into this peak season, but the slow and stable U.S. domestic business is in line with its forecasts.
UPS expects earnings per share to rise 10 percent to 15 percent and revenue to increase 6 percent to 8 percent annually from 2011 to 2016. Its capital spending will be 4 percent of revenue over the same period, focused more on growth than on maintenance.
The company also said on Thursday it is expanding capacity by 65 percent at its hub in Cologne, Germany.
On Wednesday, it announced a service that enables greater control over the timing of package delivery for residential consumers. Consumers will get alerts via text message and other means, as the company offers free and premium options to make missed deliveries a thing of the past.
Kuehn said UPS has been buying back shares at discounted prices and raised the full-year estimate by $700 million to $2.7 billion. Buybacks should reach about $8 billion between 2012 to 2014 and return on invested capital is expected to be at least 25 percent by 2014,
The investor meeting is being held at UPS's Worldport, the base for its international air express hub, its airlines headquarters and its largest distribution facility.

Three Tools To Improve Financial Negotiations

Genesis 23:15-16 is part of a land purchase negotiation between Abraham and Ephron. Abraham needed to bury his wife. He was not from the area and had to purchase land in order to do so. Ephron wanted to give the land to Abraham, but Abraham wanted to pay what the land was worth. He asked Ephron to accept the offer.
Abraham and Ephron's business transaction highlight three keys to better financial negotiations.
1) Negotiate fairly
Abraham was willing to pay the fair market price for the land.
Deuteronomy 27:18 says, "Cursed is the man who leads the blind astray on the road." (NIV) Since Abraham was not as familiar with the area's land values as the local Hittites, he had to trust that Ephron would not lead him astray.
Leviticus 19:35 reads, "Do not use dishonest standards when measuring length, weight or quantity." (NIV) Abraham hoped that Ephron would tell him the truth.
2) Keep your word
Abraham agreed to the terms and paid Ephron what he asked for the land. In all of our business negotiations, we have to do what we say we will do.
Both the inability to negotiate fairly and the inability to be honorable with our word can hinder future negotiations. If we are not trustworthy, no one will want to do business with us.
Proverbs 10:9 tells us, "The man of integrity walks securely, but he who takes crooked paths will be found out." (NIV) A tarnished reputation is not something that is easy to overcome.
3) Have witnesses to your negotiations
Ephron's terms for Abraham's purchase of the land were discussed "in the hearing of the Hittites." It can be beneficial to discuss negotiations with witnesses around.
Witnesses help reduce the chances of future disagreements. Rather than creating an atmosphere for "he said, she said," witnesses can confirm what was said by both parties in the negotiation process.
Witnesses can also ensure that all terms were arrived at fairly. Since Abraham was not familiar with the prices, the Hittite witnesses were able to confirm that the price Ephron named for the land purchase was reasonable.
Sometimes people may feel pressured into agreeing to terms that are not in their best interest. Witnesses can help keep people from signing contracts under duress.
The Bible provides so many tools to help us manage all aspects of our lives. If we keep these tips in mind as we negotiate all of our business dealings, we are much more likely to reduce, or even avoid, unnecessary future mishaps as a result.
